Topeka Kansas, Supreme Court, Jim Crow laws In our country’s history, the Supreme Court has overridden its past decisions only ten times. The most important of these overturned decisions are the rulings the Supreme Court made in the Plessy vs. Ferguson case and the Brown vs. Board of Education of Topeka Kansas. These are arguably the two most important court cases in our nation’s history. Plessy vs. Ferguson and Brown vs. Board of Education of Topeka Kansas had almost exact opposite consequences. While the Plessy vs. Ferguson case established the doctrine of â€Å"separate but equal† and allowed for acts such as the Jim Crow laws to pass, Brown vs. Board of Education of Topeka Kansas not only abolished the doctrine of â€Å"separate but equal†, but it also played a major role in ending segregation by strengthening the civil rights movement. Homer Plessy, a Louisiana resident, was light colored, but he had a black great-grandfather, which by law, made him black. Plessy lived in Louisiana. In Louisiana, there was a legislation in place that required every railway to have different railcars, one for whites, and one for colored races. Plessy sat in the white car. When a white passenger boarded the train, Plessy was told to give up his seat. When he refused, a detective put him in jail. Plessy pleaded innocent, but was convicted. Plessy and his lawyer appealed to the federal district courts. The district court upheld the decision of the lower courts. Plessy then appealed to the Supreme Court. Linda Brown had to walk six blocks every day to ride her bus, which would take her 1 mile away to a segregated black school. Her white friends, however, went to a â€Å"white† school only about seven blocks away. Linda Brown’s father, Oliver Brown, enrolled her in the â€Å"white† school, Sumner School, but she was not accepted into the school on basis of her race. Her father became very mad and with the parents of twenty other colored children, filed a class action lawsuit against the Board of Education of Topeka, Kansas. He eventually appealed to the Supreme Court. After Homer Plessy appealed to the Supreme Court, the Supreme Court evaluated the case, and came to a 7-1 discussion against Plessy (Justice David Josiah did not participate because of the death of his daughter). In his majority opinion, Justice Brown wrote, â€Å"We consider the underlying fallacy of the plaintiff’s argument to consist in the assumption that the enforced separation of the two races stamps the colored race with a badge of inferiority. If this be so, it is not by reason of anything found in the act, but solely because the colored race chooses to put that construction upon it.† Justice Brown is stating that the 14th Amendment says that all races are equal, but it does not prevent separating the facilities and services provided to each race. Any person from any race who believes his race is inferior to others because of segregation is wrong. The facilities were separate, but they were supposedly equal. This however, was not the case. While the Supreme Court could find no difference between the â€Å"black† car and the â€Å"white† car, many segregated facilities were not equal in the slightest sense. Justice John Marshall Harlan, the only justice who disagreed, wrote a strong dissent. In his dissent, he said that this case would be infamous. The Supreme Court considered Brown’s case very carefully. It was interesting to see how time changed the justices’ views. At first, only a few justices agreed to desegregate schools and other facilities. However, after a few weeks, Chief Justice Earl Warren called a convening of the Supreme Court justices. He gave a speech; a very famous speech. Warren came up with a simple argument: segregation was sustained only because of an honest belief in the supposed inferiority of blacks. He also said that the Supreme Court must overrule Plessy vs. Ferguson to maintain its legitimacy as an institution of liberty. He also said that the Supreme Court must override its previous decision in Plessy vs. Ferguson unanimously to prevent any resistance. So, the Supreme Court voted unanimously to override its decision made in Plessy vs. Ferguson. In the majority opinion, Warren wrote that segregated facilities are separated and therefore, inherently unequal. Plessy vs. Ferguson encouraged segregation. Segregation existed before Plessy vs. Ferguson, mostly in the South. Plessy vs. Ferguson strengthened segregation laws. It promoted the â€Å"separate but equal† doctrine. It also strengthened a previous decision in which the Supreme Court let the state have legislative immunity when issuing laws that dealt with race, only requiring the laws to treat people from all races equally. Congress had no say in this area. Plessy vs. Ferguson also served as the basis for other cases, such as Lum vs. Rice, in which a Mississippi school was allowed to exclude a Chinese American girl. It also allowed segregation to spread northward. The doctrine of â€Å"separate but equal† allowed for separate facilities, but consistently they were unequal. â€Å"Black† restaurants were not as nice or clean as â€Å"white† restaurants. This applied to schools, theaters, hotels, and almost every public facility. Plessy vs. Ferguson also allowed for the passing of the Jim Crow laws, which were passed mainly to keep African Americans from voting by requiring voters to give proof that they owned land and to pass a literacy test at poll stations. Every facility was segregated, but not many were equal. In Topeka, Kansas, Brown vs. Board of Education of Topeka Kansas saw the end of segregation in all elementary and middle schools; high schools were already integrated. While Brown vs. Board of Education of Topeka Kansas did see many facilities integrated, there was much opposition and resistance to this Supreme Court ruling. In the state of Virginia, Sen. Harry F. Byrd Sr. organized a movement called the Massive Resistance movement, which shut down schools rather than integrating them. The Attorney General of Texas, John Ben Shepperd, organized a campaign with the sole purpose of generating legal obstacles to integration. In 1957, possibly the most remembered example of opposition to integration, nine black students tried to enter Little Rock Central High School. Arkansas’s governor, Gov. Orval Faubus, called out his state’s National Guard to block them from entering. President Dwight D. Eisenhower deployed parts of the 101st Airborne Division and federalized Arkansas’s National Guard. Another infamous response was the Stand in the Schoolhouse Door where Alabama’s own governor, Gov. George Wallace himself stood and blocked the door at the University of Alabama to prevent two black students from enrolling. He only moved when confronted by General Henry Graham of the Alabama National Guard. Gen. Henry Graham was ordered by President John F. Kennedy to intervene. However, Brown vs. Board of Education of Topeka Kansas did strengthen the Civil Rights Movement, and played a major role in ending segregation. The 14th amendment has several sections. It discusses citizenship. If a person is born in the United States, Puerto Rico, or any other United States territory, or is born to American parents, they are automatically citizens. If a person does not fall in any of these categories, they can go through the naturalization process to become citizens. It also refutes the three-fifths compromise. It says that representatives shall be based on population of whole persons. The 14th amendment also says that a person cannot hold any kind of political or elected office if they have engaged in any form of rebellion against the U.S. However, the most important point of the 14th amendment is the Equal Protection Clause. It says, â€Å"†¦no state shall deny to any person within its jurisdiction the equal protection of the laws.† It forbids states from denying any person â€Å"life, liberty or property, without due process of law†. Seven Supreme Court justices decided that segregating facilities did not violate the 14th amendment. Facilities were separated, but they were supposedly equal. The seven justices who voted against Plessy in Plessy vs. Ferguson believed that segregated facilities were â€Å"separate but equal†. This was not just an expression. This became a doctrine. This one phrase allowed segregation to creep into the north, and allowed southern states to pass Jim Crow laws, which prevented most African Americans from voting. These are only a few consequences out of the many that were a result of the Supreme Court ruling in Plessy vs. Ferguson. The justices who unanimously voted to overturn Plessy vs. Ferguson in Brown vs. Board of Education of Topeka Kansas said that segregation in itself is inequality, and it therefore violates the 14th amendment of the Constitution, the supreme law of the land. Chief Justice Earl Warren stated it beautifully when he said that segregation is only the byproduct of an â€Å"honest belief in the inferiority of the Negroes†. So, the decision the justices made in Brown vs. Board of Education of Topeka Kansas was not just against segregation laws, it was against the cultural mindset of that time. Now, it is the most remembered court case of all time. The 14th amendment states that all races are equal and have to be treated as such. Chief Justice Warren said that segregation is inherently unequal. Therefore, by the transitive property, the 14th amendment is violated when segregation is present. These two cases are most likely the most important court cases in the entire history of the United States. One encouraged segregation and inequality while the other fought and reversed a mindset that was hundreds of years old. Although Plessy vs. Ferguson encouraged segregation, allowed for the passing of Jim Crow laws, and portrayed blacks as inferior all under the doctrine of â€Å"separate but equal†, Brown vs. Board of Education of Topeka Kansas reversed the Plessy vs. Ferguson decision, helped desegregate races and allowed for everyone to have equal opportunities. Introduction I believe that the purpose of my media audit was to take our initial idea of what we believed our media usage was and to measure and compare it to our actual quantified results. Empirical Data  Objective: To measure the causes and effects due to the influence of mass media. Can mass media highly influence a persons attitudes or perception, by abundant daily solicited or unsolicited exposure? Procedure: Measuring media exposure, within a week span of 15-minute intervals. With sixteen hours equaling one day, I summarized the total minutes for the week at approximately 6,720 minutes. My total minutes not exposed to media were about 1,407 minutes, and my total exposure to mass media was approximately 5,1313 minutes. Individual categories concluded as follows: Audio estimated at 475 minutes, Film- 100 minutes, Internet- 1,778 min, Television- 0 minutes, Mobile Devices- 2,185 minutes, and Print Media approximated 775 minutes. Subjective observations were also incorporated, to measure external factors, and their influence on the subjects’ reaction in relation to media use. Main Outcome Measures: Risk of altered perception, influenced by, attitudes and b ehaviors idolized in society and the amount of exposure weekly. Results: Media Usage Total (min) I was thoroughly surprised by the way my media usage was dispersed, as a whole, in this graph. I also judged every person’s appearance effortlessly, gossiped, and my language was atrocious. Only until the middle of my 22nd year, did I realize that I was not content, nor satisfied with my lifestyle. I decided to cut out television, bad influences, and COSMO. I didn’t think I would be able to handle it, however, to my surprise, it taught me how to live life, the way it was intended, with freedom. Releasing myself from the burden of mass media was one of the most liberating decisions I’ve ever made. I decided to return back to my Jewish roots, which I ignored during that rebellious era, and become deeper aquatinted with my faith, additionally instead of useless reality shows, I dove deep into the profound knowledge of books. Observations The first major observation I noticed in relation to my media data was the fact that my two most dominant categories increased on the weekend. This is most likely because my workweek is so hectic, that by the time I’m approaching the weekend, all my energy is geared towards relaxation. These emotions are then replaced with the action of increasing my phone/ casual conversation time. I also tend to research all those topics online, that I might have put off during the week, in order to complete my work on time. Another observation that was extremely consistent included listening to Pandora (Internet radio) whenever I worked on my art. In contrast, I would listen to my IPOD whenever I wanted to get schoolwork accomplished. On Pandora, my typical station I listen to when creating my art pieces, is always geared towards inspirational or spiritual genre. It is the only music I find, to empower me with such motivation, in order to finish my pieces with ease and in a timely manner. I also tend to listen to classical music on my IPOD, when trying to complete a class work assignment. I read an article one time that did a study on the brain and how it affects positive stimulation. The article was extremely informative and I have done it ever since. Another observation I realized, I tried to double task consistently while listening to some form of media and trying to complete concrete tasks. I believe this behavior has done more to hinder my personal effectiveness, rather than help it. It was helpful to be informed of this destructive behavior, after realizing the concrete facts. My double tasking always eventually lead to unfinished tasks, and then when I eventually became overwhelmed, I grabbed my IPOD and pulled out the classical music. It was interesting to become aware of these behaviors; I never knew I was such a creature of habit. Also, reflecting on all the realizations mentioned above, I believe that some of these destructive behaviors could be prevented, with a decrease in use of my media items, which in turn, would increase my focus. 4.Estimates Vs. Actual My Estimates were all underestimated compared to my actual data for my media usage. Like I previously stated, I didn’t realize I used my phone so much, I usually get confronted by my friends for â€Å"forgetting† to text them back, or not answering. Sometimes I feel like life would be much easier without our mobile devices. The only truly useful purpose is to locate and converse with friends that are long distance, however as far as â€Å"Smartphone,† I feel the epidemic needs to be cured. The other estimate that highly underestimated was my Internet use. I believe when I was filling those questions out, I didn’t necessarily take into account that EVERY time I click the APP button, that is using an internet resource. Imagine a world where free will is obsolete. Nobody has any freedom; most people do not even have a yearning for autonomy. The direction the world is heading right now could possibly produce such a world. Both Brave New World, by Aldous Huxley, and Fahrenheit 451, by Ray Bradbury, envision this world which lacks liberty. These books, both of which are supposed to be set in the future, have numerous theme similarities throughout them. Of all their common factors, the ones that stand out most would have to be the outlawed reading of books and the theme of the protagonist being a loner or an outcast from society because of his differences in beliefs as opposed to the norm. In the societies of both of these books outlawed reading is a common and almost completely unquestioned law. In Brave New World reading is something that all classes are conditioned against from birth. In the beginning of the novel there is a group of infants who are given bright, attractive books but are exposed to an explosion and a shrieking siren when they reach out for them. This thus prevents them from wanting the books and causes them to scream and shrink away in horror at the mere sight of the books. In reference to the accomplishment of this conditioning, the director said, "Books and loud noises...already in the infant mind these couples are compromisingly linked; and after two hundred repetitions of the same or a similar lesson would be wedded indissolubly. What man has jointed, nature is powerless to put asunder," (Huxley 21-22). We come to learn that the basic reasoning behind this conditioning against reading in Brave New World was because "you couldn't h ave lower-caste people wasting the Community's time over books, and there was always the risk of their reading something which might undesirably decondition one of their reflexes" (Huxley 22). In Fahrenheit 451 the outlawing of book reading is taken to an even greater extent. In this novel the whole purpose of a firefighter isn't to put out fires, rather it is to start fires. The reading of books in their society is completely forbidden and if someone is suspected of even owning a book, the firefighters are dispatched to go to that person's residence and start a fire. They start fires for the sole purpose of destroying books, as illustrated here, "They pumped the cold fluid from the numeraled 451 tanks strapped to their shoulders.

How Did Portugal Get Macau

Macau, a port city and associated islands in southern China, just west of Hong Kong, has the somewhat dubious honor of being both the first and the last European colony on Chinese territory.   The Portuguese controlled Macau from 1557 to December 20, 1999.   How did tiny, far-off Portugal end up taking a bite of Ming China, and holding on through the entire Qing Era and up to the dawn of the twenty-first century? Portugal was the first European country whose sailors successfully traveled around the tip of Africa and into the Indian Ocean basin.   By 1513, a Portuguese captain called Jorge Alvares had reached China.   It took Portugal two decades more to receive permission from the Ming emperor to anchor trading ships in the harbors around Macau; Portuguese traders and sailors had to return to their ships each night, and they could not build any structures on Chinese soil.   In 1552, China granted the Portuguese permission to build drying and storage sheds for their trade goods in the area now named Nam Van.   Finally, in 1557, Portugal got permission to establish a trading settlement in Macau.   It took almost 45 years of inch-by-inch negotiation, but the Portuguese finally had a real foothold in southern China. This foothold was not free, however.   Portugal paid an annual sum of 500 taels of silver to the government in Beijing.   (That is about 19 kilograms, or 41.5 pounds, with a current-day value of roughly $9,645 US.)   Interestingly, the Portuguese viewed this as a rental payment agreement between equals, but the Chinese government thought of the payment as tribute from Portugal.   This disagreement over the nature of the relationship between the parties led to frequent Portuguese complaints that the Chinese treated them with contempt.   In June of 1622, the Dutch attacked Macau, hoping to capture it from the Portuguese.   The Dutch had already ousted Portugal from all of what is now Indonesia except East Timor.   By this time, Macau hosted about 2,000 Portuguese citizens, 20,000 Chinese citizens, and around 5,000 African slaves, brought to Macau by the Portuguese from their colonies in Angola and Mozambique.   It was the Africans who actually fought off the Dutch assault; a Dutch officer reported that Our people saw very few Portuguese during the battle.   This successful defense by the Angolans and Mozambicans kept Macau safe from further attack by other European powers. The Ming Dynasty fell in 1644, and the ethnic-Manchu Qing Dynasty took power, but this regime change had little impact on the Portuguese settlement in Macau.   For the next two centuries, life and trade continued uninterrupted in the bustling port city.   Britains victories in the Opium Wars (1839-42 and 1856-60), however, demonstrated that the Qing government was losing clout under the pressure of European encroachment.   Portugal unilaterally decided to seize two additional islands near Macau: Taipa in 1851 and Coloane in 1864.   By 1887, Britain had become such a powerful regional player (from its base in nearby Hong Kong) that it was able to essentially dictate the terms of an agreement between Portugal and the Qing.   The December 1, 1887 Sino-Portuguese Treaty of Amity and Commerce forced China to give Portugal a right to perpetual occupation and government of Macau, while also preventing Portugal from selling or trading the area to any other foreign power.   Britain insisted on this provision, because its rival France was interested in trading Brazzaville Congo for the Portuguese colonies of Guinea and Macau.   Portugal no longer had to pay rent / tribute for Macau. The Qing Dynasty finally fell in 1911-12, but again the change in Beijing had little impact down south in Macau.   During World War II, Japan seized Allied territories in Hong Kong, Shanghai, and elsewhere in coastal China, but it left neutral Portugal in charge of Macau.   When Mao Zedong and the communists won the Chinese Civil War in 1949, they denounced the Treaty of Amity and Commerce with Portugal as an unequal treaty, but did nothing else about it.   By 1966, however, the Chinese people of Macau were fed up with Portuguese rule.   Inspired in part by the Cultural Revolution, they began a series of protests that soon developed into riots.   A riot on December 3 resulted in six deaths and over 200 injuries; the next month, Portugals dictatorship issued a formal apology.   With that, the Macau question was shelved once more. Three previous regime changes in China had had little impact on Macau, but when Portugals dictator fell in 1974, the new government in Lisbon decided to get rid of its colonial empire.   By 1976, Lisbon had relinquished claims of sovereignty; Macau was now a Chinese territory under Portuguese administration.   In 1979, the language was amended to a Chinese territory under temporary Portuguese administration.   Finally, in 1987, the governments in Lisbon and Beijing agreed that Macau would become a special administrative unit within China, with relative autonomy through at least 2049.   On December 20, 1999, Portugal formally handed Macau back to China. Portugal was the first in, last out of the European powers in China and much of the world.   In the case of Macau, the transition to independence went smoothly and prosperously - unlike the other former Portuguese holdings in East Timor, Angola, and Mozambique.
